Definitions

"You" means:

1. You, the user, whoever you may be;

2. Anyone benefiting from your life and well being, and;

3. Anyone standing in the place of those defined in definitions 1 or 2.

"We" means InnerPeace.Org, and any affiliated entity or person: participant, staff, volunteer, or other; except for You.

"InnerPeace" means any program used by InnerPeace.Org, whatever its name.

"Agreement" means this one entitled "Anonymity Agreement" and any revised version of it that we may publish from time to time.

 

Anonymity

InnerPeace.Org is an anonymous organization.

You agree to respect and forever maintain the anonymity of all those associated: participants, staff, volunteers, and others.

 

Nondisclosure

You agree to never disclose, directly or indirectly, in fact or in fiction, any information, including, but not limited to identities, about all those associated with us: participants, staff, volunteers, and others, even if they are public figures.

 

Penalties for Disclosure

Should you violate this agreement, in addition to any actual damages, you will donate the equivilent of one day's income to the InnerPeace Trust Fund for Homeless Children and personally serve one day of community service for every instance of exposure resulting from your disclosure.

For revelations in the press, readership, viewership, or equivalent figures shall constitute instances of disclosure.

If you are a corporation or other fictitious entity, persons responsible for any such violation shall be assigned to appropriate terms of community service.

 

Agreement to Arbitrate

Any claim or dispute you may have under this Agreement shall be decided under the rules of the American Arbitration Association, by a single arbitrator, in Asheville NC, USA, as modified below.

You agree that we may appear "In Forma Pauperis" in any action to which you are a party without filing any fees or documentation to support such an appearance. If necessary, to accomplish this, you will post any fees required for us to do so.

The prevailing party shall be awarded all attorneys fees and costs incurred.

Any of our trustees' fees related to an action shall be considered costs. Trustee fees that are donated may be charged as an "in kind" cost at the prevailing rate for non-profit paralegal work in the greater Washington DC area.

To assure that we shall be able to recover any award for costs and attorney's fees from you, along with your filing of any action against us or any answer to our filing against you, you shall also post a bond with the arbitrators for an amount equal to two times the amount of our anticipated attorneys fees and costs.

As litigation continues, upon our showing additional anticipated costs and fees, the arbitrators shall increase the amount of this required bond.

The likelihood of victory shall have no bearing on the necessity of this bond.

Your failure to post any such bond or to increase its amount as required under the terms of this Agreement shall be deemed an abandonment of the action and prevent you from futher appearance in the action, at which point the arbitrators shall award a default judgment to us.

No appearance by you "In Forma Pauperis," in whole or in part, shall alleviate either the requirement for this bond or any increase in it.

You acknowledge that our complying with any discovery or subpoena you may move to have enforced against us would be an onerous and unreasonable burden for us.

You waive all rights to have any discovery or subpoena enforced against us.

This Agreement shall be governed under the following, in order of priority:

1. This Agreement, itself; and

2. The laws of North Carolina.

For the purposes of venue, this Agreement shall be deemed automatically accepted by us in Asheville NC, USA, immediately after your acceptance of it.

 

Miscellaneous Terms

The masculine, feminine, and neuter genders, where applicable, include each other. The singular and plural numbers, where applicable, include each other.

Section heads and numbers are for convenience only and do not limit the scope of the text.

Any translation of this agreement from English shall be unofficial. Only the English version of shall be official.

In any conflict between differing versions of this Agreement, the later ones shall prevail over the earlier ones. Unless you state otherwise in your filing papers and prove to the arbitrators, it shall be presumed that you have accepted all versions of this Agreement to that date.

Should any part of this Agreement be deemed invalid or unenforceable as written, the arbitrators shall amend it to have as much of the original intent as possible, and any such amendment shall be deemed included in the original Agreement as the original intent.

This Agreement may not be amended. You may accept it in full or reject it outright. No person has the power to supersede it, no matter what his or her position may be with us.

You waive the right to put us on notice, real or effective. You accept that our keeping track of any such notices would be an onerous burden for us.

 

Your Acceptance

You assert to us that you are of legal age and capacity to enter into this Agreement, and accept that we rely on this, notwithstanding that you may have informed one or more of us that you are not. You accept that keeping track of such notices would be an onerous burden for us and that we rely solely upon your assertion.

Your acceptance of this Agreement, in then present version and any prior version you previously accepted, is automatically renewed every time you use InnerPeace.
