Definitions
"You" means:
-
You, the user, whoever you may be;
-
Anyone benefiting from your life and well being, and;
-
Anyone standing in the place of those defined in definitions 1 or 2.
"We" means InnerPeace.Org, and any affiliated entity or person: participant, staff, volunteer, or other; except for You.
"InnerPeace" means any program used by InnerPeace.Org, whatever its name.
"Agreement" means this one entitled
"Disclaimer and Waiver" and any revised version of it that we may publish from time to time.
Disclaimer
We promise, guarantee, and warranty you absolutely nothing.
We imply no guarantees or warranties of any kind.
Waiver
You assume all the risks for your use of InnerPeace and your association with us.
You waive all claims against us and waive all your rights to sue us for any reason.
Assignment
You assign all rights, including attorneys fees, court costs, and other costs, from any claim you may have against us, now or in the future, for any reason, to the InnerPeace.Org Trust Fund for Homeless Children, which may file papers in any action you may file against us to secure its rights to collect.
Notice of Judgment Proof Structure
InnerPeace.Org is legally structured as a series of trusts.
All trusts that have any assets or income have no association with you and, therefore, no potential liability to you.
Any trust that may associate with you is purposely structured to have no assets and no income so that even if you were to win an award there would be nothing for you to collect.
You understand this arrangement and accept that, if you should sue and win, there would be nothing for you to collect.
Agreement to Arbitrate
Any claim or dispute you may have under this Agreement shall be decided under the rules of the American Arbitration Association, by
three arbitrators,
in Asheville NC, USA, as modified below.
You agree that we may appear "In Forma Pauperis" in any action to which you are a party without filing any fees or documentation to support such an appearance. If necessary, to accomplish this, you will post any fees required for us to do so.
The prevailing party shall be awarded all attorneys fees and costs incurred.
Any of our trustees' fees related to an action shall be considered costs.
Trustee fees that are donated may be charged as an "in kind" cost at the prevailing rate for non-profit paralegal work in the greater Washington DC area.
To assure that we shall be able to recover any award for costs and attorney's fees from you, along with your filing of any
action against us or any answer to our filing against you, you shall also post a bond with the arbitrators for an amount equal to two times the amount of our anticipated attorneys fees and costs.
As litigation continues, upon our showing additional anticipated costs and fees, the arbitrators shall increase the amount of this required bond.
The likelihood of victory shall have no bearing on the necessity of this bond.
Your failure to post any such bond or to increase its amount as required under the terms of this Agreement shall be deemed an
abandonment of the action and prevent you from futher appearance in the action, at which point the arbitrators shall award a default judgment to us.
No appearance by you "In Forma Pauperis," in whole or in part, shall alleviate either the requirement for this bond or any increase in it.
You acknowledge that our complying with any discovery or subpoena you may move to have enforced against us would be an onerous and unreasonable burden for us.
You waive all rights to have any discovery or subpoena enforced
against us.
This Agreement shall be governed under the following, in order of priority:

-
The laws of North Carolina.
For the purposes of venue, this Agreement shall be deemed automatically accepted by us in Asheville NC, USA, immediately after your acceptance of it.
Miscellaneous Terms
The masculine, feminine, and neuter genders, where applicable, include each other. The singular and plural numbers, where applicable, include each other.
Section heads and numbers are for convenience only and do not limit the scope of the text.
Any translation of this agreement from English shall be unofficial. Only the English version of shall be official.
In any conflict between differing versions of this Agreement, the later ones shall prevail over the earlier ones. Unless you state otherwise in your filing papers and prove to the arbitrators, it shall be presumed that you have accepted all versions of this Agreement to that date.
Should any part of this Agreement be deemed invalid or unenforceable as written, the arbitrators shall amend it to have as much of the original intent as possible, and any such amendment shall be deemed included in the original Agreement as the original intent.
This Agreement may not be amended. You may accept it in full or reject it outright. No person has the power to supersede it, no matter what his or her position may be with us.
You waive the right to put us on notice, real or effective. You accept that our keeping track of any such notices would be an onerous burden for us.
Your Acceptance
You assert to us that you are of legal age and capacity to enter into this Agreement, and accept that we rely on this, notwithstanding that you may have informed one or more of us that you are not. You accept that keeping track of such notices would be an onerous burden for us and that we rely solely upon your assertion.
Your acceptance of this Agreement, in then present version and any prior version you previously accepted, is automatically renewed every time you use InnerPeace.

Software Designed with Your Privacy in Mind
Inner Peace software is
BrowserBased. Nothing you enter is sent over the internet or recorded anywhere. Inner Peace writes no cookies on your computer. Nothing is written to or read from your computer files.
Once the program is loaded into your browser window, you can disconnect your computer from the Internet and all its features will still run. Once you close the program, everything you entered into the program is erased. Because this is an open source program, you can see the source code and verify all this for yourself. You can comfortably process your issues with Inner Peace self help software, knowing that your entries are confidential.
About This Archived Collection
Inner Peace is no longer maintained by its author, and no support is
available for using the software. This collection is preserved as it stood,
and is hosted by ibiblio.org. To report a problem with these pages, such as a
broken link or a missing file, use the
ibiblio help request page.
Many of the sites this collection links to have closed or changed hands in the
years since these pages were written. Rather than send you to whoever holds
those addresses now, ibiblio has altered some of the links:

Donations are no longer accepted. The donation buttons that once appeared on
these pages, and in the programs offered here for download, sent money to the
collection's author, who has since ended their involvement with the
collection. Continuing to collect money on their behalf would not be right, so
ibiblio has removed those buttons. Pages describing the old donation policy are
left as the author wrote them, and describe how things once worked rather than
how they work now.
